Slip and Fall/Trip and Fall
In a slip-and-fall lawsuit, both the property owner and the slip-and-fall victim can be held to varying degrees of responsibility or comparative fault. Fault is typically based on the owner's duty to keep the property safe and the victim's duty to exercise ordinary care while walking on potentially slippery surfaces.
Nightclub Negligence
Nightclub owners can be held liable for their own negligence when their patrons
are injured in or near their clubs. The nightclub might
have provided inadequate security, or negligently allowed
a minor situation to get out of control. The nightclub
might have violated state law or local building codes,
like failing to install sprinklers or failing to have
enough emergency exits, and allowed their guests to
get hurt as a result. Or, their security guards themselves
might injure people.
